====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 20-12-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in connection with Basantpur P.S. Case No. 286/2022 registered for the offence under Section 414 of the I.P.C. and Sections 25(1-b)a, 26 and 35 of the Arms Act.

The prosecution case, in brief, is that from possession of the petitioner, knife and live cartridge are said to have been recovered.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 20.06.2022. Charge sheet has been submitted in the present case. There is no allegation of tampering with the witnesses alleged against the petitioner. Knife and live cartridge are said to have been recovered from

Patna High Court CR. MISC. No.48776 of 2022(2) dt.20-12-2022 2/2 possession of the petitioner. There is no compliance of Section 100 Cr. P.C.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances of the case, the petitioner, above-named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan, in connection with Basantpur P.S.
