The petitioner seeks bail in connection with Mansi P.S. Case No. 224 of 2017 registered under Sections 30(A) of Bihar Prohibition and Excise Act-2016.

88.440 lts. of foreign liquor is said to have been recovered from the bush kept hidden by the petitioner and the petitioner managed to escape seeing the police party. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his conscious physical possession. The petitioner has neither concern with the place of occurrence nor with the seized liquor. He has been named in the case by Chaukidar at the instance of his Gotiya.

Patna High Court Cr.Misc. No.1620 of 2018 (2) dt.24-01-2018 2/2 He is on inimical terms with the petitioner. The petitioner is resident of Khutiya village which is far away from the place of occurrence. He has been languishing in custody since 7.11.2017. In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge, 1st Khagaria-cum-Spl. Judge Excise Act, Khagaria in connection with Mansi P.S. Case No. 224 of 2017.
