2. I.A. No. 01 of 2021 is for condonation of delay. For the reasons stated in the application and affidavit, delay of 105 days stands condoned and I.A. is allowed.

3. Learned counsel for the appellants after arguing for some time, he could not apprise in terms of para 7 of the learned Single Judge's order where the learned Single Judge has taken note

Patna High Court L.P.A No.67 of 2021 dt.21-07-2022 2/2 of decision of this Court (Division Bench) wherein the said appellants have not preferred S.L.P before the Apex Court, therefore, it has attained finality.

4. Filing of this type of appeal is totally without application of mind. When this Court expresses that appeal would be dismissed with exemplary cost, at this juncture, learned counsel for the appellants seeks permission to withdraw this appeal.

5. Accordingly, appeal stands dismissed as withdrawn. In view of the withdrawal of the present L.P.A., I.A. No. 02 of 2021 stands disposed off.
