Petitioner seeks bail in Kadwa P.S.Case No. 186 of 2021 registered for the offences punishable under Sections 341, 323, 307, 504, 506,34 of the Indian Penal Code and Section 27 of the Arms Act.

As per prosecution case, Members of Bajrang Dal made firing near Durga Mandir but no one was injured. Due to firing there was a panic situation in the market. It is submitted on behalf of the petitioner though there is allegation of firing but no one was injured by the said firing and as such no case under section 307 is made out. No

Patna High Court CR. MISC. No.59064 of 2021(2) dt.07-02-2022 2/2 firearms has been recovered from possession of the petitioner. Petitioner is in custody since19.07.2021. Investigation is complete.

Considering the aforesaid facts and circumstances as well as submissions of the parties and also period of detention of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar in connection with Kadwa P.S.Case No. 186 of 2021.
