BADAR ORAL ORDER 23-12-2022 The applicant is accused in Crime No. 164 of 2022 registered with Daudpur Police Station for the offences punishable under Section 307 read with Section 34 of the Indian Penal Code as well as Section 27 of the Arms Act, by this application is seeking his release on bail during pendency of the trial after filing of charge sheet.

Heard the learned counsel appearing for the applicants/accused. He argued that First Informant - Akash Kumar Singh is dreaded criminal and he has only suffered minor leg injury. The accused persons had filed cross FIR in respect of the same incident.

The learned Additional Public Prosecutor opposed the application by contending that the crime in question is serious.

According to the First Informant - Akash Kumar Singh, the applicant had called him from the house and had taken him to his house where co-accused Prakash Puri @ Mantu Puri had fired bullet at him causing leg injury to him. The investigation of the crime in question is over. It is reported by the learned counsel for the applicant that the injured is perfectly alright. In this view of the matter, the following orders :- i. The application is allowed.

ii. The applicant/accused in Crime No. 164 of 2022 registered with Daudpur Police Station be released on bail on executing P.R. Bond of Rs.10,000/- (Rupees Ten Thousand) and on furnishing surety of the like amount to the satisfaction of the Trial Court with the following conditions :- (I) The applicant/accused should not extend any threat, promise of inducement to the persons acquainted with the facts of the accusation against him so as to dissuade him from disclosing such facts to the Court or to any police officer. (II) The applicant/accused should cooperate the Trial Court in expeditious disposal of the trial against him.

No.49445 of 2022(2) dt.23-12-2022 3/3 (III) The applicant/accused should not repeat commission of similar offence in future and if they are found to be involved in commission of similar offence, the State is at liberty to apply for cancellation of bail granted to the applicants in the instant case.

(IV) The applicant/accused should not tamper with the prosecution evidence in any manner.
