2. The petitioner apprehends his arrest in a case registered for the offence under Section 8(b), 18, 29 of the N.D.P.S. Act.
3. As per F.I.R., this petitioner is alleged to be involved in cultivation of opium plants.
4. Learned counsel for the petitioner submits that land in question, on which opium is alleged to be cultivated, does not belong to this petitioner, rather it belongs to forest department. He further submits that in the entire F.I.R., there is no direct evidence against this petitioner that he cultivated the opium plant on the alleged land. Name of the petitioner transpired in this case due to dirty village politics.

5. Learned A.P.P. for the State has opposed the prayer for anticipatory bail.
6. Considering the aforesaid facts and circumstances, in the event of arrest/surrender before the Court below within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge-cum-Special Judge, NDPS Act, Gaya in connection with Barachatti P.S. Case No. 1175 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
