JUSTICE PURNENDU SINGH ORAL ORDER 30-07-2025 Heard Mr. Jai Prakash Verma, learned counsel appearing on behalf of the petitioners; Ms. Rita Verma, learned APP for the State and Mr. Santosh Kumar, learned counsel for informant.

2. The petitioners seek pre-arrest bail in connection with Sahebganj P.S. Case No. 240 of 2024 registered for the offence(s) punishable under Sections 420, 467, 468, 471 and 120B of the Indian Penal Code.

3. Allegation is that taking advantage of the unsound health of the brother of the informant, the accused persons in an

No.47518 of 2025(2) dt.30-07-2025 2/3 organized manner got a piece of land appertaining to Khata No. 92, Khesra No. 1375 executed in their name for a total consideration amount of Rs. 6 lacs and subsequent to that on the pretext of necessary correction in the sale deed, another sale deed was executed by the petitioners.

4. Learned counsel appearing on behalf of the petitioners submitted that no fraud has been committed in view of the fact that informant and his brother had voluntarily accepted the consideration amount and had executed the sale deed and now they have lodged an F.I.R. making false accusations.

5. Mr. Santosh Kumar, learned counsel tendered his appearance on behalf of the informant and submitted that the petitioners got the piece of land executed belonging to the family of the informant and also deceived the informant by getting another sale deed executed by him on the consideration amount of less than what is mentioned in the MVR.

6. Now, both the parties have agreed to resolve their dispute amicably.

7. In such circumstances, the matter is referred to the District Mediation Centre, Muzaffarpur for amicable settlement between the parties.

8. Both the parties are directed to appear before the learned District Court on 05.08.2025. Thereafter, the learned District Court will fix a date of appearance of the parties before the learned Mediator.

9. Learned Mediator of the District Mediation Center concerned shall make his/her best efforts to settle the dispute amicably and thereafter submit his/her report before the concerned learned District Court, well within a period of four months.

10. In the meantime, no coercive steps shall be taken against the petitioners in connection with the aforesaid case.

11. In case of failure to appear before the learned Mediator of the District Mediation Centre, the interim protection granted to the petitioners shall lose its force.

12. Accordingly, the present bail application stands disposed of.
