Mr.Satyendra Prasad ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 26-07-2019 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Gogari P.S. Case no. 109 of 2019, registered under Sections 447, 341, 323, 307, 379 and 504/34 of the Indian Penal Code.

The accusation is that on 03.04.2019 at about 11.00 A.M., five persons named in the F.I.R., including the petitioners, variously armed with weapons, came at the house of informant and started constructing toilet, then informant and his son told them for measurement of the land then petitioner No.2 Indal Raj gave iron rod blow at the head of the informant,

Patna High Court CR. MISC. No.46267 of 2019(2) dt.26-07-2019 2/2 when son of the informant came to save him then he was also assaulted by means of Lathi by petitioner No.1 Dinesh Singh. At that time they snatched golden locket of the informant. Learned counsel for the petitioners submits that the occurrence took place due to land dispute in which petitioners side also sustained injuries regarding which Gogari P.S. Case No. 110 of 2019 was instituted on the basis of fardbeyan of Chanda Devi. Further submission is that the injuries as found on the person of informant and his son are simple in nature. The petitioners have no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Khagaria in connection with Gogari P.S. Case No. 109 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
