The petitioner apprehends his arrest in connection with Lalganj P.S. Case No. 08 of 2021 registered under Section 30(a) of Bihar Prohibition and Excise Act.
Submission of learned counsel for the petitioner is that petitioner is innocent and has falsely been implicated in the present case. Petitioner has no criminal history. Learned A.P.P. appearing on behalf of the State opposed the prayer of the petitioner by contending that the petitioner is the owner of the alleged Scooter from which the alleged recovery of illicit liquor has been made. Hence, this is not a fit case of anticipatory bail.
Having considered the facts and circumstances of the case
Patna High Court CR. MISC. No.58699 of 2021(2) dt.15-04-2022 2/2 and the submissions advanced on behalf of the opposite party, this Court is not inclined to grant anticipatory bail to the petitioner.
