Petitioner, already in custody, seeks bail in Fulkaha PS Case No. 87 of 2017, registered under Sections 420, 482, 488 and 120B of the IPC and Section 104 of the Trade Mark Act. The allegation in brief is that 15 bags of fertilizer were recovered from the house of the petitioner along with some empty sacks.

Submission is that the petitioner is a farmer and had purchased those fertilizer for use in agriculture, he has no criminal antecedent of similar nature however there is only one case against him under Sections 307 and 379 IPC.

Having considered the said facts and circumstances, the petitioner Braham Deo Yadav @ Barmi Yadav is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of CJM Araria in connection with Fulkaha PS Case No. 87 of 2017.
