Patna High Court Cr.Misc. No.42573 of 2015 (4) dt.18-12-2015 2/3 punishable under Sections, 302, 201/34 of the Indian Penal Code and accordingly, both the above stated petitions are being disposed of by this common order.

Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioner in Cr. Misc. No. 42573 of 2015 is elder brother in law of the deceased whereas petitioner in Cr. Misc. No. 35418 of 2015 is second wife of husband of the deceased. The present case was lodged after recovery of dead body of the deceased and in course of investigation, the brother of the deceased gave a written report to police mentioning this fact that his sister was found missing and he noticed blood in the room of husband of the deceased. Admittedly, none has seen the actual killing of the deceased and the marriage of petitioner in Cr. Misc. No. 35418 of 2015 had taken place with consent of the deceased. So far as recovery of blood stained earth and ornaments are concerned, the same have been recovered from the room of husband of the deceased.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount
