JUSTICE ARUN KUMAR ORAL ORDER 21-02-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Ramgarh (Nuaon) P.S.Case No. 289 of 2017 registered under Section 392 of the Indian penal Code.
Allegation in brief is that three miscreants came on motorcycle and looted the motorcycle of the informant and also his mobile.
Submission is that two mobiles were recovered one from SAdhu Yadav @ Rajesh Yadav and another from Gopi Jaiswal, but no incriminating article was recovered from his possession except his own mobile and he was made accused on the basis of disclosure of his name in the confessional statement of co-accused Gopi Jaiswal and Sadhu Yadav and petitioner was also not put on TIP.
