JUSTICE DINESH KUMAR SINGH ORAL ORDER 02-09-2016 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 23.7.2012 in a case registered for the offences punishable under Sections 20,22,23,24,27A and 29 of the NDPS Act.

On secret information that the miscreants are bringing ganja from Nepal, raid was laid when five persons carrying one bag each were seen. One person was apprehended with a bag but four persons escaped from the scene throwing their bags. The apprehended person was the petitioner. From five bags 100 kilogram ganja were seized.

The report of the learned Additional Sessions Judge III,

Patna High Court Cr.Misc. No.36649 of 2015 (3) dt.02-09-2016 2/2 West Champaran at Bettiah reflects that the evidence has been closed.

Considering the commercial quantity of recovery and in view of the embargo under section 37 of the NDPS Act coupled with the present stage of trial, this court is not inclined to grant bail to the petitioner in connection with Kangali P.S. Case No. 37 of 2012 (Trial No. 48 of 2012) pending in the court of learned 3rd Additional District and Sessions Judge, Bettiah, West Champaran. This application is, accordingly, dismissed. However, let the trial be expedited.
