JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 23-04-2018 This writ petition has been filed by the petitioner for directing the respondent authorities especially respondent no. 4, to dispose of the complaint application dated 11.05.2017, which was filed before him by one Dinesh Kumar Singh. The petitioner has further prayed for directing the respondent no. 2 to issue direction to all the Deputy Labour Commissioners for implementing the
Patna High Court CWJC No.13259 of 2017 (4) dt.23-04-2018 2/3 direction of the Secretary to Government of India Ministry of Labour and Employment, New Delhi in compliance of the direction issued by the Supreme Court in Contempt petition (Civil) No. 411 of 2014 arising out of Writ Petition (Civil) No. 246 of 2011 regarding implementation of the Majithia Wages Board Award and taking action in terms of section 17 of the Working Journalists and other Newspaper Employees (Conditions of Service) and Miscellaneous Provisions Act, 1955. It is submitted by the learned counsel for the petitioner that after receipt of the complaint, as contained in Annexure - 1 to the writ petition, the respondent no. 4 has directed the respondent nos. 5 and 6 to produce the records, registers and muster rolls vide his letter dated 13.06.
2017 as contained in Annexure-2 to the writ petition. He submitted that in compliance with Annexure-2, the management filed reply objection challenging the legality and validity of the proceeding on 30.06.2017. The reply to the objection was also filed on behalf of the petitioner. Admittedly, after receipt of the complaint as contained in Annexure - 1 to the writ petition, respondent no. 4 has directed respondent nos. 5 & 6 to produce the records, registers and muster rolls. The matter is being contested by the parties before respondent no. 4.
Patna High Court CWJC No.13259 of 2017 (4) dt.23-04-2018 3/3 the respondent no. 4, the instant writ petition is premature. I do not think it proper to issue any direction at this stage commanding the respondents to pass order in one manner or the other. It would be open for the respondent no. 4, who is dealing with the complaint of the petitioner, to pass order expeditiously in accordance with law.
