====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR ORAL ORDER 05-02-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Motihari Nagar PS Case No. 568 of 2017 registered under Sections 147, 149, 341, 323, 324, 307, 504 and 506 of the IPC.

The allegation in brief is that the petitioner and others assaulted the informant with knife causing injury to him. Learned Counsel for the petitioner submits that the allegation of assault with knife is general and omnibus and out of seven injuries six are abrasion and one is incised wound, however all the injuries are simple in nature and there is no piercing injury. The petitioner has got criminal antecedent but is on bail in those cases. Having considered the said facts and circumstances, the petitioner, namely, Umang Dubey is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM East Champaran at Motihari in connection with Motihari Town PS Case No. 568 of 2017.

However considering the antecedent of the petitioner, if further any criminal offence is committed by the petitioner his bail bonds shall be liable to be cancelled in accordance with law. Snkumar/- (Arun Kumar, J.) U T
