Heard the learned counsel for the petitioners and learned APP for the State.

The petitioners apprehend their arrest for the offences alleged under Sections 341, 323, 325, 379, 307, 504 and 506/34 of the Indian Penal Code, registered in connection with Bhagwanpur P.S.Case No. 104 of 2021.

As per allegation, the accused persons assaulted the family members of the informant. The specific allegation against petitioner no. 1 is of assaulting Taiyab Ansari on his

Patna High Court CR. MISC. No.59857 of 2021(2) dt.13-07-2022 2/2 head and specific allegation against petitioner no.2 is that he inflicted rod blow on Salma Khatoon.

The learned counsel for the petitioners has submitted that the injuries sustained by the injured persons are simple in nature. Both the parties are next-door neighbours. Considering the above facts and circumstances as well as the nature of injury, let the petitioners above-named, in the event of their arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each, with two sureties of the like amount each to the satisfaction of Judicial Magistrate 1st Class, Siwan in connection with Bhagwanpur P.S.Case No. 104 of 2021, subject to the conditions as laid down under Section 438(2) Cr. P.C.

Office shall ensure that all defects are removed by the petitioners within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
