The petitioner seeks bail in connection with Ara Town P.S. Case no. 18 of 2018 registered under Section 30(a) of Bihar Excise Prohibition Act-2016.

146.21 lts. of foreign liquor is said to have been recovered from the possession of the petitioner who is said to have been ferrying the said liquor.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his conscious physical possession. He has no concern either with the seized liquor or with the place of occurrence. The aforesaid liquor was not recovered from the possession of the petitioner rather from

Patna High Court Cr.Misc. No.12785 of 2018(2) dt.06-03-2018 2/2 the open land. The seizure list does not bear the signature of the petitioner. He has no criminal antecedent. He has been languishing in custody since 12.01.2018.

In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned 4th Additional Sessions Judge, Bhojpur Ara in connection with Ara Town P.S. Case no. 18 of 2018.
