====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 22-12-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in connection with Sarmera P.S. Case No. 131 of 2022 registered for the offence under Sections 25 (1-b) a and 26 of the Arms Act.

The prosecution case, in brief, is that the petitioner abused one Jitendra Kumar. It is also alleged that the petitioner apprehended the petitioner and from his possession, one loaded country made pistol was recovered.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 23.05.2022. He has got no criminal antecedent. Charge sheet has been submitted in the present case. There is no allegation of tampering with the witnesses alleged against the petitioner. One loaded country

Patna High Court CR. MISC. No.49435 of 2022(2) dt.22-12-2022 2/2 made pistol is said to have been recovered from possession of the petitioner. There is no compliance of Section 100 of Cr.P.C. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances of the case, the petitioner, above-named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Biharsharif, in connection with Sarmera P.S. Case No. 131 of 2022.
