JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-07-2019 This application, for grant of anticipatory bail, arises out of Barharia P.S. Case No. 93 of 2019, disclosing offences under Sections 147, 149, 149, 341, 323, 332, 337, 307, 353 and 504 of the Indian Penal Code.

Police, while patrolling, received an information that a dispute is going on at Village Madhopur for installation of switch of transformer, on which, the police went there and an altercation took place and about 20 to 30 persons attacked the police and also pelted stone and petitioner is also named in the F.I.R.

Submission of learned counsel for the petitioner is that though petitioner is named in the F.I.R., no specific allegation has been attributed to him and he has no criminal antecedent and has falsely been roped in the present case.

Having heard both sides, considering the submission, as above, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan, in connection with Barharia P.S.
