This application for anticipatory bail arises out of Sarairanjan P.S. Case No. 128 of 2020 for the offence punishable under Sections 188, 269, 270, 323/34, 353 and 427 of the Indian Penal Code.
It is submitted by learned counsel for the petitioners that the allegations against these petitioners are not serious in nature.
Since, the petitioner no.2 is a Government servant and petitioner no.3 is a young person, one chance should be given to him to reform himself though he has one criminal

Considering the aforesaid facts, let the petitioner nos. 2 and 3, above named, in the event of their arrest/surrender within four weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, III, Samastipur, in connection with Sarairanjan P.S. Case No. 128 of 2020, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
Since the petitioner no.2 is a Government servant, he is directed to file an affidavit before the Court below that in future he will not indulge in such kind of activities and if it is found that he is indulged in such kind of activities, his bail bonds shall be cancelled by the Court below.
So far as the petitioner no.1 is concerned, his prayer for bail is rejected as he has three criminal antecedents. However, if the petitioner no.1 surrenders before the Court below within a period of four weeks from today and seeks regular bail, the Court below shall consider and decide the same on its own merit without being influenced by this order. The Court below shall also consider the fact that similarly situated
