JUSTICE BIRENDRA KUMAR ORAL ORDER 27-02-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is in custody in connection with Khagaria (Chitragupta Nagar) P.S. Case No. 528 of 2017, G.R. No. 2250 of 2017, a case under Sections 399, 402 of the Indian Penal Code and Section 25 (1-b)A, 26 and 35 of the Arms Act. The petitioner is in custody since 06.08.2017. Country made pistol and two live cartridges were allegedly recovered from possession of the petitioner.

Allegation is that petitioner was apprehended when he was planning to commit dacoity along with other named accused. Submission is that the petitioner is in custody since 06.08.2017 and has got no criminal antecedent.

No.11164 of 2018 (2) dt.27-02-2018 2/2 Considering the aforesaid fact, let the petitioner, above named, be released on bail after framing of charge or on completion of three months in custody from today on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Khagaria (Chitragupta Nagar) Police Station Case No. 528 of 2017, G.R. No. 2250 of 2017 with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
