KUMAR ORAL ORDER 13-02-2018 Heard learned counsel for the petitioner, learned counsel for the informant and learned counsel for the State. The petitioner seeks bail in Chandi P.S. Case No. 211 of 2017 registered for the offence punishable under Sections 304B/34 of the Indian Penal Code.

Informant is the mother of the deceased, who has stated in her FIR that her daughter was married to the petitioner but due to no issue/children, her in-laws used to torture. On 28.06.2017 at about 4:00 pm she received information that her daughter had died due to hanging and when she came to the matrimonial home of her daughter, no in-laws of the deceased was found in the house. According to her they have killed her by hanging. From the post mortem report enclosed, it appears that she died of Asphyxia due to hanging. There is no any other

Patna High Court Cr.Misc. No.3266 of 2018(3) dt.13-02-2018 2/2 injury found on her body. Petitioner has got no criminal antecedent and is in custody since, 04.09.2017. Learned counsel for the informant vehemently opposes the prayer for bail.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda (Biharsharif) in connection with Chandi P.S.
