The petitioner apprehends his arrest in Kaluaahi P.S. Case No.86 of 2019 registered under Sections 272, 273 and 34 of the Indian Penal Code.
The informant got secret information that Pappu Mishra and this petitioner were unloading illicit liquor from a truck. On such information, the informant reached there and seeing the police, the accused persons managed to flee away. On search, the police recovered huge quantity of liquor from the truck.
Learned counsel for the petitioner submits that there is nothing on record to show that the petitioner had brought liquor. The truck was found parked far away from the house of the petitioner. The petitioner is not the owner of the vehicle and he
Patna High Court CR. MISC. No.46487 of 2019(5) dt.20-11-2019 2/2 has got no criminal antecedent. Co-accused Pappu Mishra has already been granted anticipatory bail by order dated 03.09.2019 passed in Cr.Misc.No.55594 of 2019.
Having considered the fact aforesaid and the fact that similarly situated co-accused has already been granted anticipatory bail, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge II-cum-Special Judge (Excise Act), Madhubani in connection with Kaluaahi P.S. Case No.86 of 2019, subject to the conditions as laid down under Section 438
(2) of the Code of Criminal Procedure.
