JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 14-12-2021 At the outset, learned counsel for the petitioners prays that he may be permitted to withdraw this anticipatory bail petition filed on behalf of petitioners no.4 and 7 as petitioners no.4 and 7 have already been arrested by the police. Prayer is allowed.
This anticipatory bail petition is dismissed as withdrawn so far as petitioners no.4 and 7 are concerned. Heard learned counsel for the petitioners, learned APP for the State as well as learned counsel appearing on behalf of the informant.
Petitioners apprehend their arrest in Purushottampur P.S. Case No.61 of 2020, registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 307, 379, 427, 504, 506 of the Indian Penal Code and 27 of the Arms Act.
Patna High Court CR. MISC. No.8557 of 2021(3) dt.14-12-2021 3/3 Learned counsel for the petitioners submits that the petitioners have falsely been implicated in the present case. There is general and omnibus allegation against all the accused persons. It is submitted that nobody sustained any gun shot injury. It is lastly submitted that the petitioners have got no criminal antecedent.
Learned counsel for the informant opposes the prayer for anticipatory bail of the petitioners.
Having considered the facts aforesaid, let petitioners, above named, except petitioners no.4 and 7, in the event of their arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bonds of Rs.25,000/- (rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Bettiah, West Champaran in connection with Purushottampur P.S. Case No.61 of 2020, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure. (Anjani Kumar Sharan, J.) Sanjay/- U T
