2. Learned counsel for the petitioner submits that the case of the petitioner is duly covered by the judgment dated 11.05.2018 passed by a Co-ordinate Bench of this Court in CWJC No. 8963 of 2018 (Chandra Shekhar Azad & Ors v. The State of Bihar & Ors.).

3. Per contra, learned counsel for the State submits that the case of the petitioner shall be examined by the respondent

Patna High Court CWJC No.11113 of 2024(3) dt.27-03-2025 2/2 no.5 and in case, it is found that the case of the petitioner is similar to that of case of Chandra Shekhar Azad & Ors. (supra), similar benefit would be given.

4. Considering the submissions advanced on behalf of the parties, the present writ petition is disposed of with liberty to the petitioner to approach the District Programme Officer, Establishment, East Champaran, Motihari (respondent no.5) by filing a representation within a period of four weeks from today, which shall be decided by respondent no.5 within a period of eight weeks from the date of receipt of the representation after affording an opportunity of hearing to the petitioner or through his counsel and in case, it is found that the petitioner is similarly situated to that of the petitioners of CWJC No. 8963 of 2018, similar benefits would be granted to him.

5. With the aforesaid observation and direction, the petition stands disposed of.
