The petitioner is languishing in jail since 12.02.2015 in a case registered for offences punishable under Sections 304 (B), 201 and 34 of the Indian Penal Code.

The prosecution case as alleged by the informant, who is mother of the victim Shanti Kumari, has submitted a written report before the Officer-in-charge of Maniyari P.S. on 27.07. 2013 stating therein that she had married her daughter Shanti Kumari on 30.04.2011 with one Kamlesh Kumar Mahto. Initially relation was very good but later on Kamlesh Kumar Mahto and his parents including the petitioner started torturing Shanti Kumari and the daughter which was of the informant informed to informant through mobile. On 27.07.2013 the informant came to know that her daughter has been killed and her dead body has been disposed of and when informant along with

Patna High Court Cr.Misc. No.33642 of 2015 (2) dt.19-08-2015 2/2 her villagers went to the house of her daughter, she found that the accused persons had locked the door of the house and left. Because of demand of dowry, the accused persons including the petitioner has burnt her daughter.

Learned counsel for the petitioner submits that she is mother-in-law of the victim, Shanti Kumari and has no criminal antecedent. There is no specific allegation against this petitioner and during investigation, the witnesses have specifically stated that the deceased died due to diarrhea and vomiting. A Co-ordinate Bench of this Court in Cr. Misc. No. 44715/2014 dated 04.02.2015 has granted privilege of bail to Mintu Mahto, father-in-law of the deceased victim. I do not propose to take different view.

In view of the facts and circumstances, let the petitioner, namely, Anju Devi @ Ranju Devi be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 10th Additional Sessions Judge, Muzaffarpur in connection with Sessions Trial No. 256/2015 arising out of Maniyari P.S.Case No. 146/2013.
