2. The petitioner apprehends his arrest in connection with Tetiabambar P.S. Case No. 44/2025 instituted under Sections 191(1), 191(2), 191(3), 132, 115(1), 118, 262, 263 of the Bhartiya Nagrik Suraksha Sanhita, 2023 and Sections 30(a), 32 of the Bihar Prohibition and Excise Act.
3. As per prosecution case, during the vehicle checking conducted by the police, two persons came on bullet motorcycle and after seeing the police they tried to flee, but the police apprehended them who disclosed their names as Moti Singh and Himanshu Kumar. On search, two liters of wine were recovered from the motorcycle. It is alleged that after apprehending them when the police men were returning, 25-30 unknown persons
Patna High Court CR. MISC. No.46947 of 2025(3) dt.14-10-2025 2/3 with stick and rod surrounded them and freed both the apprehended persons from the police custody. On verification, the name of some unknown persons came in the light including the petitioner.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. The petitioner has no concern with the co-accused or the bullet motorcycle in question. He also submits that no incriminating material has been recovered from the conscious physical possession of the petitioner and except the suspicion there is no material against him. The petitioner is a government school teacher having no criminal antecedent and he undertakes to cooperate in the investigation and the trial.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.
6. Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge Excise-II, Munger in connection with
