2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 303(2), 318(2), 318(4), 338, 319(2), 336(2), 336(3), 340(2) and 61(2) of the Bharatiya Nyaya Sanhita (in short 'BNS'), 2023.

3. The case of the prosecution is that police reached the house of this petitioner and from his house, his ATM card, his mobile number, his PAN card etc. were seized.

4. Learned counsel for the petitioner submits that all the seizure has been made from the house of the petitioner and all the seized items belong to the petitioner. No incriminating articles have been recovered from the possession of this petitioner. Learned counsel further submits that similarly

Patna High Court CR. MISC. No.48247 of 2025(2) dt.08-08-2025 2/2 situated co-accused, namely, Kamlesh Kumar has been granted regular bail vide Cr. Misc. Case No. 49910 of 2025 dated 06.08.2025. The case of this petitioner stands on similar footing. Moreover, learned counsel for the petitioner submits that the petitioner is a man of clean antecedent and is in judicial custody since 05.04.2025.

5. Learned APP for the State has vehemently opposed the application for bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Cyber P.S. Case No. 38 of 2025 on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate- 1st Class, Nawada.
