2. The petitioner has prayed for bail in connection with Tekari P.S. Case No.24 of 2024 registered for the offence punishable under Sections 302, 201/34 of the Indian Penal Code.
3. The case of the prosecution is that the sister of the informant was married with one Dharmendra Yadav 12 years ago. The husband of the deceased was working as a labourer in Surat. It is further alleged that the accused persons being the father-in-law and mother-in-law and other in-laws used to harass the deceased in absence of her husband. It is further alleged that
Patna High Court CR. MISC. No.47324 of 2025(3) dt.08-10-2025 2/3 on 10.01.2024 he received an informant from one of the villagers of her matrimonial house that all the accused persons killed his sister and going to cremate the dead body.
4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. Petitioner is brother-in-law and he was separate from the deceased. It has also been submitted that the nature of allegation is general and omnibus and there is no eye witness to this case. It has also been submitted that similarly situated co-accused persons have been granted bail by leaned Co-ordinate Bench vide order dated 11.04.2025 passed in Cr. Misc. No. 75368 of 2024. The case of this petitioner stands on similar footing. Petitioner is languishing in judicial custody since 26.03.2025.
5. Learned APP appearing for the State has vehemently opposed the application for bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned
