JUSTICE ARUN KUMAR ORAL ORDER 05-04-2018 Heard learned Counsel for the petitioners and the State. Petitioners, already in custody since 13.2.2018, seek bail in Sadar (Mufassil) PS Case No. 559 of 2017 registered under Sections 341, 323, 307, 504 and 506/34 of the IPC.

The allegation in brief is that petitioner No. 1 hit brother of the informant from bicycle in the way and thereafter quarrel took place, petitioner No,. 1 is said to have inflicted knife blow to the informant's brother by stabbing him eight times. Learned Counsel for the petitioners submits that the allegation is false and fabricated, quarrel took place due to accident by bicycle, multiple small injuries like abrasion were found, one round shaped wound on scapular area was found on the informant's brother however the injuries are simple in nature caused by hard blunt substance.

Having considered the said facts and circumstances, the petitioners, namely, Md. Aslam and Md. Sanjoor @ Md. Sanjoor Nadaf @ Sanjoor are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Purnea in connection with Sadar (Mufassil) PS Case No. 559 of 2017.
