Petitioner is in jail custody since 20.10.2014 in a case registered under section 307 and other minor sections of the Indian Penal Code on the accusation that he gave dagger blow on the belly of the injured due to some petty quarrel.

No doubt, injury found on the abdomen of the injured was grievous in nature but admittedly, there was no repetition of blow and alleged occurrence took place on account of sudden altercation and provocation.

Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of Smt. Anindita Singh, Judicial Magistrate, Ist Class, Bhagalpur/concerned court in Akbar Nagar P.S.
