The petitioner is languishing in custody for the offences punishable under Sections 341/323/324/326/307/379/34 of the Indian Penal Code.
According to FIR, with intent to rob the money of the informant the petitioner and others persuaded him to go for a feast. Thereafter, petitioner dashed him from behind and others asked to rob him. Co-accused Jay Ram Sahni is alleged to have assaulted with knife to the informant. The doctor has found lacerated cut near the upper lid of the informant. Opinion was reserved and no finding was given because the patient did not turn before the doctor.
Patna High Court Cr.Misc. No.10001 of 2018 (3) dt.03-04-2018 P2/ Submission is that there is no occurrence of robbery and false allegation is there due to some other dispute. The petitioner has got no criminal antecedent and is in custody since 02.01.2018.
Considering the aforesaid fact, let the petitioner, above named, be released on bail after completion of four months of custody on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with A.P.M. P.S. Case No.123 of 2009, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
