====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 31-07-2025 Heard learned counsel for the petitioners and the State.

2. Petitioners apprehend arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 74, 303(2), 3(5), 109, 352, 351(2) of the Bharatiya Nyaya Sanhita.

3. As per F.I.R., co-accused Palinath Sah assaulted on the head of husband of the informant with iron rod. Further allegations is that all the accused persons including these petitioners disrobed informant and snatched her Mangalsutra.

4. Learned counsel for the petitioners submits that petitioners have falsely been implicated in this case. Specific

Patna High Court CR. MISC. No.48969 of 2025(2) dt.31-07-2025 2/2 accusation of assault is against co-accused Palinath Sah. So far these petitioners are concerned, allegation of assault is general and omnibus and there is no specific accusation of overt act against them. Injuries allegedly caused by these petitioners are simple in nature. Rest of the allegations are ornamental. Case and counter case. Petitioners claim clean antecedent.

5. Learned A.P.P. for the State vehemently opposed the bail application.

Considering the nature of accusation, case and counter case and clean antecedent, this anticipatory bail is allowed and it is ordered that let the above named petitioners in the event of their arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Saran in connection with Sahajitpur P. S. Case No. 18 of 2025, subject to condition as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
