Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State and also heard learned counsel for the complainant.

Petitioner happens to be husband of the complainant and is languishing in jail custody since 5.6.2015 in a case in which cognizance has been taken for the offence punishable under section 498A of the Indian Penal Code and section 3/ 4 of the D.P. Act. According to complaint case, marriage of the petitioner was solemnized with the complainant 14 to 15 years ago and after marriage complainant gave birth to two children who are residing with the complainant.

It would appear from perusal of complaint petition as well as the impugned order that petitioner has solemnized his second

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Ist Class, Danapur, Patna in Complaint case no. 817C/2014. shahid (Hemant Kumar Srivastava,J) U T
