JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 25-08-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named in the first information report but in course of investigation, it came to light that petitioner had illicit relation with the deceased and on the basis of aforesaid fact as well as call details of deceased and co-accused Suresh Yadav, petitioner was made accused in this case.

It would appear from perusal of the impugned order that on the basis of confessional statement of petitioner and coaccused, the dead body of deceased was recovered but it appears that the learned court below has committed error on the record as according to the informant while he was going to search of his father, he found the dead body of the deceased. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional District Judge IInd, Supaul in connection with session trial no. 36 of 2015 arising out of Pipra P.S.Case No. 184 of 2014.
