Heard learned counsel for the petitioners and learned APP for the State.
Learned counsel for the petitioners is expected to honour his undertaking to remove the defects as pointed out by the office when called upon to do so by the office. The instant application for anticipatory bail has been filed by the petitioners apprehending their arrest in connection with Kankarbag P.S. Case no. 277 of 2020 instituted for the offence under Sections 147, 148, 149, 323, 341, 342, 385 and 387 of the Indian Penal Code.

No.5606 of 2021(2) dt.26-11-2021 2/3 As per allegation in the FIR, petitioner no. 1 along with fifty others, armed with pistol, came to the home of the informant, assaulted him badly and threatened the informant to withdraw the earlier case and to pay all the expenditure which incurred in an earlier case lodged by the informant against petitioner no. 1. Petitioner no. 2 is father of petitioner no. 1. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. There is case and counter case. In the Fardbeyan, nothing has been mentioned about the weapons used during the time of threatening. In fact, the present case has been lodged for the purpose of save the skin from the earlier case i.e. Kankarbag P.S. Case no. 278 of 2020, which was lodged against the informant by the petitioner no. 1.
Learned APP appearing for the State has opposed the prayer of bail.
Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioners on bail. The petitioners are directed to surrender in the Court below within a period of four weeks from today and in the event of their arrest or surrender in connection with Kankarbag P.S. Case no. 277 of
Patna High Court CR. MISC. No.5606 of 2021(2) dt.26-11-2021 3/3 2020, they will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Patna subject to the conditions as laid down under section 438(2) of the Cr.P.C.
