2. The petitioner seeks bail in a case registered for the offence punishable under Sections 30(a) and 32(3) of the Bihar Prohibition and Excise Act.
3. As per prosecution case, 204 litres illicit liquor was recovered from seized car of which this petitioner was driver.
4. It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. No incriminating article has been recovered from conscious possession of this petitioner and has been made an accused in this case merely he happens to be driver of the vehicle in question. Without the knowledge of this petitioner, the illicit liquor was loaded in the seized vehicle. Petitioner has got no

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.
6. Considering the facts and circumstances of the case, nature of accusation, clean antecedents of the petitioner and period of custody, the prayer for grant of bail to the petitioner is allowed.
7. Accordingly, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge, Excise Court No. II, Siwan in connection with Siwan Excise P.S. Case No. 315 of 2025.
