The petitioner seeks bail in a case registered for the offence punishable under Sections 302, 120 (B)/34 of the Indian Penal Code and Section 27 of the Arms Act.

Allegation against the petitioner is that he committed murder by fire arms to the brother of the informant and the brother of the informant is the eye witness.

Learned counsel for the petitioner submits that the petitioner is in custody since 04.04.2019.

Learned APP has opposed the prayer of bail.

From perusal of the case diary, it appears that the petitioner has confessed his guilt regarding involvement in the alleged occurrence and he is accused in various cases.

Patna High Court CR. MISC. No.47527 of 2019(4) dt.03-02-2020 2/2 Considering the aforesaid facts, I am not inclined to enlarge the petitioner on bail. Accordingly, the prayer for bail of the petitioner is rejected in connection with Barhara (Raghubanshnagar) P.S. Case No. 62/2019 from the Court of learned Additional Chief Judicial Magistrate-II, Purnea. The application is accordingly dismissed.

However, the court below is directed to expedite the trial and conclude the same as early as possible.
