The petitioner seeks bail in a case registered for offences punishable under Sections 477(A), 409, 436, 120B, 201/34 of the Indian Penal Code.

Allegation, as set out in the first information report is that almirah in which documents relating to the proceedings against the petitioner were kept was set on fire. The first information report has been lodged by the Rural Development Officer, Dulhin Bazar. On inquiry, it was found that the previous Nazir, i.e., the petitioner was seen along with some other persons in the Block even after everybody had returned to their home. Thus, under conspiracy, he along with others have set the almirah

Mr. Yogesh Chandra Verma, learned Senior Counsel appearing for the petitioner has submitted that petitioner was never seen during such occurrence by anybody and everything is revolving upon suspicion. Petitioner was suspended after perusal of the records and, therefore, nothing can be achieved by him by setting the concerned almirah on fire. That apart, it is not clear as to actually who has set the almirah on fire and the implication of the petitioner is merely on suspicion.

Having regards to the facts and circumstances of the case, the petitioner, namely, Jitendra Kumar is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Rahul Kumar, J.M. 1st Class, Danapaur in Dulhin Bazar P.S. Case No. 133/2014.
