2. Petitioner apprehends arrest in a case registered for the offence punishable under Section 30 (a) of the Bihar Prohibition and Excise Act-2018.

3. Prosecution case is that 157.560 liters foreign liquor were recovered from car in question .

4. It is submitted that the petitioner is innocent and has falsely been implicated in this case. Petitioner is neither driver nor owner of the vehicle in question . No incriminating material has been recovered from the conscious possession of the petitioner.

5. Learned counsel for the State submits that petitioner has got two criminal antecedent of which one is of

Patna High Court CR. MISC. No.50815 of 2023(2) dt.17-08-2023 2/2 similar nature.

6. Considering the facts of the case as also the fact that petitioner has got one criminal antecedent of similar nature, prayer for anticipatory bail is rejected.
