====================================================== CORAM: HONOURABLE MR. JUSTICE HARISH KUMAR ORAL ORDER 04-11-2025 Heard learned Advocate appearing on behalf of the petitioner and the learned Additional Public Prosecutor for the State.

2. The petitioner apprehends his arrest in connection with Bahadur P.S. Case No. 157 of 2024, registered for the offences punishable under Sections 341, 323, 406, 307 and 34 of the Indian Penal Code.

3. The allegation against the petitioner is of having caused injury upon the head of the informant alongwith others.

4. Learned Advocate appearing on behalf of the petitioner submitted that the injury which is allegedly sustained over the head of the informant is found to be simple in nature as per the medical opinion; all the more, other accused persons facing identical allegation have been allowed the privilege of

Patna High Court CR. MISC. No.48002 of 2025(3) dt.04-11-2025 2/3 anticipatory bail by a co-ordinate Bench of this Court in Criminal Miscellaneous No. 84440 of 2024 vide order dated 11.12.2024. There is a counter version of the present case being Bahadur P.S. Case No. 165 of 2025 instituted against the informant. The petitioner bears fair antecedent and he undertakes that he will fully cooperate in the proceeding of the Court.

5. On the other hand, learned Advocate for the State vehemently opposed the pre-arrest bail application and submits that there is a corresponding injury over the head of the informant, which shows the complicity of the petitioner in crime.

6. Regard being had to the submissions made on behalf of the parties and considering the simple nature of injury and the factum of case and counter case, coupled with the fair antecedent let the petitioner above named be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Patna City in connection with Bahadurpur P.S. Case No. 157 of 2024,

Patna High Court CR. MISC. No.48002 of 2025(3) dt.04-11-2025 3/3 subject to the conditions laid down in Section 482(2) of the Bharatiya Nagrik Suraksha Sanhita, 2023 with the further condition that one of the bailors shall be the own/close family members of the petitioner.
