JUSTICE SATYAVRAT VERMA ORAL ORDER 08-03-2022 Heard learned counsel for the petitioner and Mr. Rajendra Nath Jha, learned A.P.P. for the State. The petitioner seeks bail in connection with Ara Nawada P.S. Case No. 215 of 2015 instituted for the offences under Sections 419, 420, 467, 468 and 471 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is in custody since 19.08.2021 is a person with clean antecedent and charge-sheet has been submitted in the case. Learned counsel for the petitioner submits that the informant in the First Information Report alleges that the petitioner was selected by a Selection Committee presided over by the Collector on the post of Assistant Technical Manager and during the course of verification of the educational documents,

No.58928 of 2021(2) dt.08-03-2022 2/3 the Jodhpur National University by its letter dated 16.05.2015 informed that the petitioner was never a student of the said university nor the documents submitted by the petitioner was issued by the university, hence, it is alleged that the petitioner attempted to seek appointment based on forged and fabricated documents.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case, the petitioner was not given any opportunity to explain his side of the story. It is further submitted that the petitioner had taken admission in the university but the university played fraud with the petitioner as his admission was beyond the sanctioned quota and hence, the university disowned him when his educational qualification certificate was sent for verification. It is further submitted that petitioner resigned immediately when he came to know that the university has not supported the documents sent for verification. It is further submitted that petitioner has not received any salary for the work done. It is further submitted that the petitioner was completely unaware that an First Information Report came to be instituted against him based on the report of the university as such, he could not earlier surrender in time. Learned A.P.P. for the State vehemently opposes the

Considering the fact that the petitioner is in custody since 19.08.2021, is a person with clean antecedent and chargesheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Ara Nawada P.S. Case No. 215 of 2015.
