JUSTICE HEMANT GUPTA ORAL JUDGMENT Date: 10-11-2016 The petitioner has sought intervention of this Court to complete the investigations of Shastrinagar P.S. Case No.159 of 2016 for the offences under Sections 328, 302 and 34 of the Indian Penal Code. The First Information Report is in respect of death of elder brother of the petitioner.

2. In the counter affidavit filed it is stated that the investigations are in progress wherein the statements of the petitioner and other witnesses were recorded. It is also pointed out that viscera of the deceased were sent to Forensic Science

Patna High Court Cr. WJC No.803 of 2016 dt.10-11-2016 2/2 Laboratory, Patna for examination and that report is awaited. Since reason of death is not clear, therefore, the viscera report is relevant.

3. In view of the fact that investigations are in progress and awaiting report of Forensic Science Laboratory, therefore, no further action is called for. Needless to say that the police is expected to conclude the investigations at an early date in accordance with law.

4. This writ petition is, thus, dismissed.
