The petitioner seeks regular bail in connection with C.I. Case No. 157 of 2021 instituted for the offences under Sections 30(a) and 56(b) of the Bihar Prohibition and Excise Act, 2016.
Learned counsel for the petitioner submits that the petitioner is in custody since 31.08.2021, is a person with clean antecedent and prosecution report has been submitted in the case.
Learned counsel for the petitioner submits that allegation is of recovery of 144 litres of liquor from the dickey
Patna High Court CR. MISC. No.58937 of 2021(2) dt.07-01-2022 2/2 of the vehicle as detailed in the F.I.R.
Learned counsel for the petitioner submits that the petitioner is neither the owner nor the driver of the said vehicle rather had taken lift and came to be implicated when search was made.
Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner.
Considering the fact that the petitioner is in custody since 31.08.2021, prosecution report has been submitted in the case and the petitioner is a person with clean antecedent, let the petitioner above named be released on bail on furnishing bail bond of Rs. 1,000/- (Rupees One Thousand only) with two sureties of the like amount each to the satisfaction of learned Special Judge (Excise), Purnia in connection with C.I. Case No. 157 of 2021.
