2. The petitioner seeks bail in connection with Durgawati P.S. Case No. 63 of 2024 registered for the offence under Sections 399/402 of the Indian Penal Code and under Sections 25(1-b)a, 26, 35 of the Arms Act.

3. As per the prosecution case, the petitioner and other criminals were caught while planning a loot and one country made pistol was recovered from one co-accused namely Vikash Yadav. There is recovery of one mobile phone from the petitioner.

4. It has been submitted by the learned counsel for the petitioner that the petitioner has no criminal history and he is in custody since 11.3.2024.

5. Considering the aforesaid facts, this application is allowed.

6. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court of Additional Sessions Judge-IX, Kaimur at Bhabhua in connection with S.Tr. No. 176 of 2024 arising out of Durgawati P.S. Case No. 63 of 2024.

7. As a condition of this order, the petitioner after being released on bail is directed to mark his attendance at Chand Police Station on first and third Sunday of each month. Any default in appearance at the police station will result in cancellation of bail bonds of the petitioner. (Sandeep Kumar, J) Vikas/- U T
