The petitioner apprehends his arrest in a case registered for the offence under Sections 341, 323, 308, 379, 504, 506/34, 354, 354A, 354B of the Indian Penal Code and Sections 3 / 4 of Witch Craft Practices Act.

As per the prosecution case, all the F.I.R. named accused persons including this petitioner assaulted the informant and his family members and thereafter, committed theft. It is submitted on behalf of petitioner that due to land dispute between the parties, this false case has been lodged against petitioner and after investigation, chargesheet has been submitted under Sections 341, 323, 354, 504A of the Indian Penal Code. Petitioner has got clean antecedent.

Patna High Court CR. MISC. No.49184 of 2022(2) dt.15-12-2022 2/2 Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - V, Sikarhana, Dhaka, East Champaran in connection with Kundwa Chainpur P.S. Case No. 62 of 2019, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
