The petitioner seeks bail in connection with Obra P.S. Case No. 324 of 2021 dated 13.12.2021 instituted for the offences under Sections 399 and 402 of the Indian Penal Code and Sections 25(1-b)a, 26 and 35 of the Arms Act. The petitioner was one of the five persons who was arrested on suspicion for planning for committing some offence. From the possession of the petitioner, a country made pistol and one cartridge was recovered.

The learned counsel for the petitioner submits that he is in custody since 13.12.2021.

Though the petitioner has been made accused in

Patna High Court CR. MISC. No.50089 of 2022(2) dt.09-12-2022 2/2 altogether five cases about which reference has been given in para-3 of the bail petition but, the learned counsel for the petitioner submits that because of his accusation in such cases, he has been arrested in this case only on suspicion. The petitioner denies of there being any recovery from his possession and submits that the seizure list has been prepared maliciously.

Regard being had to the aforenoted facts and the period of custody, the petitioner is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Aurangabad in connection with Obra P.S.
