JUSTICE MADHURESH PRASAD ORAL ORDER 05-04-2018 Heard counsel for the petitioner and APP for the State. Petitioner is an accused in a case registered for offence under sections 25(1-B), A/26/35 IPC.

Learned counsel for the petitioner submits that at the behest of his enemies he has falsely been implicated in this case. He disputes and denies the recovery as the seizure list has not been made in accordance with law. It is further submitted that the petitioner is in custody in connection with this case since 26.8.2017 and upon his arrest in this case he has been remanded in Forbesganj Police Station Case No. 559 of 2017. In respect of other case arising out of Jogbani Police Station Case No. 68 of 2005, the petitioner is already on bail. In the facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/-

Patna High Court Cr.Misc. No.11443 of 2018 (3) dt.05-04-2018 2/2 (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Araria in Forbesganj Police Station Case No. 659 of 2017 on the following conditions:- (a) One of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner.

(b) He/she will be well represented on each date and if he/she fails to do so on two consecutive dates, his/her bail will be liable to be cancelled.
