The petitioner apprehends her arrest in connection with Banshi P.S. Case No.45 of 2018 registered under Sections 304(B)/34 of the Indian Penal Code.
The accusation is that the deceased, the daughter of the informant, was subjected to torture and cause assault by her husband and other in-laws for non-fulfillment of the demand of dowry and, ultimately, she was killed by them by sprinkling kerosene oil.
Learned counsel for the petitioner submits that the petitioner is the mother-in-law of the deceased, the daughter of the informant. In fact, the deceased sustained burn injury in course of cooking meal and she was rushed for treatment to the
Patna High Court CR. MISC. No.45747 of 2019(2) dt.24-07-2019 2/2 hospital, where she died in course of treatment. Further submission is that Lalu Yadav, the husband of the deceased, is already in custody. After realizing the mistake, the informant has filed a petition in the court of the Additional Chief Judicial Magistrate-I, Arwal, on 26.04.2019 to the effect that due to misconception, he has lodged the present case. Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of her arrest or surrender by her within six weeks from today, be enlarged on bail on her furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Arun Kumar, Additional Chief Judicial Magistrate, Arwal, in connection with Banshi P.S. Case No.45 of 2018, subject to the conditions laid down under Section 438(2) Cr.P.C.
