The petitioner seeks bail in Bhagwanpur Hatt P.S. Case No.201 of 2017 registered under Section 272, 273 and 308 of the Indian Penal Code and Section 30 (a) & 41 (1) of the Bihar Prohibition and Excise Act, 2016.
358.92 liters of foreign liquor is said to have been recovered from the hut of the petitioner and petitioner was apprehended. The said seized liquor is said to be of Amit Singh and Bikram Singh.
It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the conscious physical possession of the petitioner. He has no concern
Patna High Court Cr.Misc. No.8448 of 2018 (02) dt.16-02-2018 2/ 2 with the Amit Singh or with the seized liquor. He has been falsely implicated in this case due to dirty village politics. He has no criminal antecedent. The said Amit Singh has been enlarged on bail by this Court in Cr. Misc. No.2227 of 2018 vide order dated 24.01.2018. He has been languishing in custody since 12.09.2017. In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II-cum-Special Judge Excise Act, Siwan in connection with Bhagwanpur Hatt P.S. Case No.201 of 2017.
